Board of Adjustments approves conditional use for equipment rental business

The Meade County Board of Adjustments held its regular monthly meeting Aug. 2. Present were chairman Jess Mills and board members Louis Crawford
and Joe Hobbs.
Allen Hicks requested a conditional use permit for his property located at 1940 Brandenburg Road in Brandenburg. The property is zoned B-1, business.
Mr. Hicks will be leasing the property to American Earth Works, LLC. The proposed use of the property is outside storage of materials for equipment rental. The surrounding uses are predominately commercial enterprises. This property has been used as commercial for a number of years.
Following discussion, Joe Hobbs made a motion to approve Mr. Hicks’ application for a conditional use permit with the following conditions.
Condition #1: There will be an approved development plan, which includes a minimum setback requirement of 50 feet and buffer areas for screening which requires a permanent landscaped buffer of evergreens or a solid wall fence with a minimum height of six feet. It was also noted that the surrounding property is zoned business and agricultural and that a chainlink fence will be erected around the business. An office trailer will be utilized as the business office.
Condition #2: If required, the applicant will obtain the approval of the Kentucky Department of Housing, Buildings and Construction, the Meade County Health Department, the Kentucky Department of Highways and the state fire marshal. The applicant must comply with all of the requirements of building, housing, health, and other regulations;
Condition #3: Any security lighting on the premises is to be directed towards the parking area, and away from Highway 448/Brandenburg Road. There is to be no glare from the security lights onto Highway 448/Brandenburg Road.
Condition #4: No equipment will be stored outside of the fencing at any time.
Condition #5: The applicant must receive approval from the Environmental Office for use of a holding tank for the septic.
Condition #6: The applicant must comply with the minimum requirements of the B-1 district.
Condition #7: Hours of operation for the business will be from 8 a.m. to 5 p.m., Monday through Saturday.
Condition #8: There will be three employees working at the business.
This conditional use permit is valid for a period of six months from date of approval and is null and void if not exercised within this time period. In addition, the administrative official shall review all conditional use permits on an annual basis and has the authority to inspect the land or structure where the use is located in order to determine whether the applicant is complying with all of the conditions. If the applicant is found to be in violation of any of the conditions, the permit is subject to revocation.
