Board of Adjustments approves variance and conditional use permit

The Meade County Board of Adjustments met Nov. 15, approving one land variance and one conditional use permit.
Kathy Benenati applied for a variance for her R-1 (residential) property located on Lot 8 in River Edge. Benenati, who was represented at the meeting by builder Gerald Morris, requested a variance for 3.3’ in order to build a porch that will encroach on the side yard setback. Although the property consists of 1.009 acres, due to a sinkhole on the property the environmental office has stated this is the only location on the property that the 4,326-square foot home could be built. The developer, who created the lot prior to planning and zoning, has no problem with the variance request.
Builder Gerald Morris also stated that the porch, which would wrap around the entire home if the variance were to be approved, would protect the log home and help maintain the look of the home for a longer time period.
Joe Hobbs made a motion to approve Benenati’s request, which was seconded by Louis Crawford. The motion passed unanimously.
The second order of business for the morning was a conditional use application submitted by Randall Ryan, owner of AA Collision Center. Ryan requested that the property – zoned B-2 (business) – located at 2434 Old Mill Road in Brandenburg be approved for outside storage of materials for his auto repair business. AA Collision is currently located on Hwy 60, but Ryan is moving his business to the Old Mill Road location.
The Board of Adjustments stipulated that seven conditions must be agreed upon and satisfied in order for the conditional use to be approved. These conditions included privacy screening of either evergreens or a fence and no vehicles stored outside of the fencing at any time. Ryan agreed to all of the conditions and stated he planned to erect a privacy fence, with the idea that it is better business to screen any wrecked vehicles from the public’s view.
Joe Hobbs made a motion to approve the conditional use permit, which was seconded by Louis Crawford and unanimously approved by the board.
