In the latest courtroom drama involving Harvey Weinstein, a Manhattan judge has declared a mistrial due to a hung jury, unable to reach a unanimous decision after two days of deliberations, which took place on May 15. This marks the third time Weinstein has been tried under the same rape allegation by an aspiring actress from 2013.

The Journey Through the Courts
The spotlight was solely on Jessica Mann, the accuser in this particular case, differing from previous instances where multiple testimonies were considered. Mann’s initial victory in 2020, which led to Weinstein’s conviction, was subsequently overturned, necessitating further trials. Last year’s efforts also saw a deadlocked jury, prompting this most recent retrial. During another trial in 2025, Weinstein was acquitted in Mann’s case but found guilty of sexually assaulting Miriam Haley, a former “Project Runway” assistant.
Justice Curtis Farber, overseeing this trial, acknowledged the jury’s deadlock as irreconcilable, opting to dismiss them without pushing for further deliberation. It now falls to Manhattan District Attorney Alvin L. Bragg to decide whether a fourth trial should be pursued. Bragg’s predecessor initially handled the prosecution.
Weinstein’s Defense and Current Status
During the proceedings, Mann recounted how a planned morning meeting diverted to a hotel room, where Weinstein allegedly raped her after using medication to enable sexual performance. The prosecution faced the challenge of having no physical evidence and relied heavily on Mann’s testimony against Weinstein’s defense.
Weinstein, who is also appealing a 16-year sentence from a separate sexual assault conviction in Los Angeles, maintains his innocence. In a recent interview, he conceded to being overly aggressive in his advances but denied any accusations of sexual assault.
As the legal tangles continue, Weinstein’s narrative remains complex, with past actions under scrutiny and future trials potentially on the horizon. This ongoing legal saga not only revisits the serious allegations but also underscores the challenges in conclusively resolving high-profile cases in the #MeToo era.
